Terms of Use

By accessing or using VGCINEMA (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

2. Your account

You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at security@vgcinema.ai if you suspect unauthorized access.

3. Credits and billing

• Generations consume credits. Credit costs are shown at the time of generation.
• Subscription plans grant credits monthly; unused subscription credits roll into your balance.
• One-time credit packs never expire while your account is active.
• Failed generations are refunded automatically.

4. Acceptable use

You agree not to use the Service to generate or distribute content that:

• Is illegal under applicable law, including sexual content involving minors (CSAM).
• Impersonates a real person without their consent (including public figures).
• Promotes violence, terrorism, self-harm, or hate against a protected class.
• Defames, harasses, or invades the privacy of any individual.
• Infringes copyright, trademark, or other intellectual property rights.
• Misleads viewers about real events (deceptive deepfakes).

4a. User-generated content & takedown

You are solely responsible for the prompts you submit and the videos you generate, publish, or distribute ("User Content"). We do not pre-screen User Content and act as a neutral platform under Section 230 of the U.S. Communications Decency Act and Article 14 of the EU Digital Services Act.

We reserve the right — but not the obligation — to remove any User Content that violates these Terms, applicable law, or a valid takedown notice, without prior notice and without refund. We will respond to properly formatted DMCA notices sent to our registered DMCA Designated Agent (see our Copyright Policy) and to lawful government orders. You agree to indemnify VGCINEMA against all third-party claims arising from your User Content.

4b. Subscription disclosure & cancellation (California ARL)

In compliance with California's Automatic Renewal Law (Bus. & Prof. Code §17600 et seq.) and similar laws in other U.S. states:

• Before checkout we clearly disclose the price, billing frequency, and auto-renewal of every subscription plan.
• You expressly authorize recurring charges by completing checkout; we send an email acknowledgement summarizing the same terms.
• You may cancel at any time from the in-app billing portal in two clicks or fewer — no phone call, no email required. Cancellation takes effect at the end of the current billing period and stops all future charges.
• For price increases or material plan changes, we provide at least 7 days' advance notice by email and an opportunity to cancel before the change takes effect.

5. Ownership of generated content

Subject to your compliance with these Terms, you own the videos generated for you, including for commercial use on paid plans. You grant us a limited license to host, process, and display your content for the purpose of operating the Service.

6. Service availability

We provide the Service "as is" and do not guarantee uninterrupted availability. Underlying AI models change over time and outputs are not deterministic.

7. Termination

We may suspend or terminate your account for violations of these Terms. You may cancel anytime from your billing portal. See our Refund Policy.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the greater of $100 or the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which VGCINEMA is established, without regard to conflict-of-law principles.
